1. What is your view of the 2004 Attorney General Opinion regarding access to streams from county road bridges ?
I believe all Montanans should have access to streams at county road bridges.
2. In your opinion are public property rights important - often as important as private property rights?
Yes.
3. Do you believe the state should be allowed to acquire water rights sufficient to allow major streams to function as natural aquatic systems?
Yes. I presume the reference is to recognizing in-stream flow as a beneficial use.
4. Are you familiar with and do you support the Public Trust Doctrine?
Yes.
5. Should we consider the sale of water in Montana’s rivers to be moved out of state?
There may be opportunities to consider, and generally, I support negotiated agreements with downstream states that would provide benefits to Montana. However, we need to be very careful about the "sale" of water as a commodity and locking into transactions that become detrimental to Montana water users and meeting their needs.
6. Should the Montana Department of Fish, Wildlife and Parks remain the sole decision maker for the allocation of licenses and permits that determine who may legally hunt and harvest Montana wildlife ?
It is my understanding that the MDFWP is governed by its Commission, and the "Department" cannot act with sole discretion on any matter without Commissioners taking action. I believe the system of a Commission directing the department, with commissioners representing distircts and making decisions on licenses and permits has served Montana pretty well over the decades. There appears to be enough checks and balances and I don't believe any stakeholders are being left out of decision making.
7. What should be done to reduce elk populations that exceed optimum numbers as defined in current management plans?
I leave it to the Commission to consider the alternatives, solicit and receive public input, and make the right decision.
