1. What is your view of the 2004 Attorney General Opinion regarding access to streams from county road bridges ?
I agree with Attorney General Mazurek. If the bridge is owned by the taxpayer than he has every right to use it but never to abuse any surrounding private property. I think some of the discussion in this area is due to abuse of a right rather than appropriate use of it.
2. In your opinion are public property rights important - often as important as private property rights?
Constitutionally speaking, private property rights are a basic right of a free people and raise above any public right. That said, there are always situations that occur and each one should judged on its own merits.
3. Do you believe the state should be allowed to acquire water rights sufficient to allow major streams to function as natural aquatic systems?
No
4. Are you familiar with and do you support the Public Trust Doctrine?
Yes.I can't say that I agree with the Public Trust Doctrine in total but i do believe the public has a right to access publically held property in all legal ways for their enjoyment and pleasure without compromising private property rights.
5. Should we consider the sale of water in Montana’s rivers to be moved out of state?
No.
6. Should the Montana Department of Fish, Wildlife and Parks remain the sole decision maker for the allocation of licenses and permits that determine who may legally hunt and harvest Montana wildlife ?
Yes.
7. What should be done to reduce elk populations that exceed optimum numbers as defined in current management plans?
Laws on hunting could be expanded to allow special hunting permits when necessary for population reduction. Elk hunting areas should be kept easily accessible.
