1. What is your view of the 2004 Attorney General Opinion regarding access to streams from county road bridges ?
Attorney General Mazurek's May 26th, 2000 opinion is consistent with MCA23-2-310 through 23-2-322. I would agree.
2. In your opinion are public property rights important - often as important as private property rights?
Private property rights are one of the founding principles of a free people as defined in the US and Montana Constitution. I have taken an oath to defend that paramount right and will do so.
3. Do you believe the state should be allowed to acquire water rights sufficient to allow major streams to function as natural aquatic systems?
There is no language in the Montana State Constitution that allows the prioitization of water rights based on different opinions of beneficial use. To do so would require the opening of a Montana Constitutional Convention and I oppose that.
4. Are you familiar with and do you support the Public Trust Doctrine?
Our 1972 Montana State Constitution does not include the Public Trust Doctrine. I have taken an oath to defend our Montana Constitution.
5. Should we consider the sale of water in Montana’s rivers to be moved out of state?
No.
6. Should the Montana Department of Fish, Wildlife and Parks remain the sole decision maker for the allocation of licenses and permits that determine who may legally hunt and harvest Montana wildlife ?
No.
7. What should be done to reduce elk populations that exceed optimum numbers as defined in current management plans?
This problem is just beginning. The anti-hunting and anti-gun crowd have been successful in decreasing the number of young people pursuing this great outdoor recreation. Without statisitcs, and using purely ancedotal evidence, I am amazed at how few hunters are out in recent years. It seems I can hunt all day long without seeing other hunters. That's odd; plenty of game but few to no hunters. The political left has removed man's involvement in the control over game and the health of our wild populations will suffer in the end.
