1. What is your view of the 2004 Attorney General Opinion regarding access to streams from county road bridges ?

I agree with the opinion. Future legislation should solidify the right and set clear protocol for mitigating any conflict related to public access. There should also be ample public discretion for restricting access in the interest of public safety sndf other social concerns.


2. In your opinion are public property rights important - often as important as private property rights?

Public and Private property rights should be viewed as equal. However, there are a number of reasons that Montana may choose to prioritize one or the other to enhance certain social goals. These decisions need to be weighed heavily in an open political process.


3. Do you believe the state should be allowed to acquire water rights sufficient to allow major streams to function as natural aquatic systems?

The allocation of water rights should not come at the expense of natural aquatic ecosystems. Whatever the vehicle, the integrity of our natural aquatic systems must be maintained.


4. Are you familiar with and do you support the Public Trust Doctrine?

Yes


5. Should we consider the sale of water in Montana’s rivers to be moved out of state?

Montana's water should not be exported out of state for sale.


6. Should the Montana Department of Fish, Wildlife and Parks remain the sole decision maker for the allocation of licenses and permits that determine who may legally hunt and harvest Montana wildlife ?

Yes


7. What should be done to reduce elk populations that exceed optimum numbers as defined in current management plans?

Hunting is the most effective and sustainable solution for the management of elk herds, and should be employed as the first tool.
