1. What is your view of the 2004 Attorney General Opinion regarding access to streams from county road bridges ?

I support the Attorney General's opinion. In the 2007 session, I voted "yes" to bring SB 78 to the floor of the House for debate and a vote. All House Republicans voted "no" thereby killing the bill for the 2007 session. When this legislation comes forward again in 2009, I intend to vote "yes."


2. In your opinion are public property rights important - often as important as private property rights?

Public property rights are extremely important for Montanans who want access to public lands for hunting, fishing, and recreation.


3. Do you believe the state should be allowed to acquire water rights sufficient to allow major streams to function as natural aquatic systems?

Yes, not only for today but for the future as well.


4. Are you familiar with and do you support the Public Trust Doctrine?

Yes, I am familiar with it and do support it.


5. Should we consider the sale of water in Montana’s rivers to be moved out of state?

No. We must protect the state's water not only for today, but for future generations.


6. Should the Montana Department of Fish, Wildlife and Parks remain the sole decision maker for the allocation of licenses and permits that determine who may legally hunt and harvest Montana wildlife ?

Yes. The Department works for the people of the state and they have established a democratic process which should be maintained


7. What should be done to reduce elk populations that exceed optimum numbers as defined in current management plans?

Using procedures already in place and using a democratic process, increase access. Do not violate the Public Trust Doctrine.
